Indemnification of Personnel
Under no circumstances shall the Company, its Directors, Officers, Shareholders, or Founders be held personally liable for any direct, indirect, incidental, punitive, or consequential damages resulting from platform downtime, data loss, business interruption, or system errors.
Consultants & Partners
All Third-Party Consultants, External Engineers, Independent Service Providers, and Content Creators acting on behalf of or alongside DScholar Web are fully protected under this disclaimer and shall bear no individual or vicarious civil liability.
Absolute Limitation of Financial Liability
To the maximum extent permitted by applicable law, DScholar Research Consultancy and Analytics (OPC) Private Limited, its directors, employees, and contracted service providers shall not be liable for any loss of revenue, loss of business, operational interruptions, loss of data, corrupted files, security breaches, or unexpected server outages.
In jurisdictions where limitations of liability are restricted, the aggregate financial liability of DScholar Web across all claims shall never exceed the total fee actually paid by the user to DScholar Web for the specific individual service in dispute over the preceding 30-day period.
No Advisory Guarantee
Information shared during e-Workshops, free consultations, or advisory meetings is for educational and technical guidance only. We do not guarantee specific financial results, revenue performance, or marketing outcomes.
Third-Party Vendors
We use third-party tools, plugins (e.g., SpeedyCache, SureCookie), payment systems, and external cloud infrastructure. We are not liable for outages, security flaws, or updates originating from external software vendors.
User Backup Obligations
Clients and end-users remain solely responsible for maintaining external, offline backups of their website database, media files, and sensitive credentials. DScholar Web is not responsible for unrecoverable data loss.
Governing Law & Dispute Jurisdiction
This Disclaimer and any disputes arising out of or related to the use of DScholar Web services shall be governed exclusively by and construed in accordance with the laws of India.
Any legal proceedings, claims, litigation, or arbitration must be filed strictly under the exclusive territorial jurisdiction of the competent courts in Agartala, Tripura, India. By accessing our platform or engaging our services, users explicitly consent to this forum selection and waive any objections regarding inconvenient forum or jurisdictional authority.
